These Terms & Conditions describe general policies applicable to electrical services performed by Bright Right LLC, doing business as Bright Right Electric (“Bright Right,” “Contractor,” “we,” “us,” or “our”).

Project-specific pricing, scope of work, payment schedules, materials, start and completion dates, warranties, and other requirements will be identified in the applicable estimate, proposal, service agreement, home improvement contract, or change order.

If these website Terms & Conditions conflict with a written agreement signed by Bright Right and the Customer, the signed agreement will control.

1. Scope of Work

Bright Right will perform the electrical work specifically described in the Customer's accepted proposal, estimate, work order, or contract.

Work, materials, repairs, upgrades, or services not expressly included in the agreed Scope of Work are not included in the original contract price.

Electrical work is frequently performed in areas where existing conditions cannot be completely evaluated until work begins. Discovery of additional work does not automatically make that work part of the original Scope of Work.

    2. Estimates and Pricing

Pricing is based upon the conditions reasonably observable or disclosed at the time the estimate or proposal is prepared.

Unless expressly stated otherwise in writing, pricing does not include additional work resulting from concealed, unknown, unsafe, damaged, defective, or non-code-compliant conditions discovered after work begins.

Any modification to the Scope of Work may result in an adjustment to the contract price, payment schedule, and estimated completion date.

    3. Changes and Additional Work

Changes requested by the Customer or required because of previously unknown conditions, inspectors, utilities, governmental authorities, code requirements, or other circumstances outside the original Scope of Work may require a written Change Order.

When required by applicable law, Change Orders will be approved in writing by both Bright Right and the Customer before the additional work begins.

    A Change Order may modify:

    • The Scope of Work
    • Materials or equipment
    • Contract price
    • Progress payments
    • Project schedule
    • Estimated completion date

Bright Right is not obligated to perform work outside the agreed Scope of Work without appropriate authorization.

    4. Hidden and Unforeseen Conditions

Electrical systems often contain components that are concealed behind walls, ceilings, floors, panels, underground areas, equipment, or other finished surfaces.

Bright Right is not responsible for conditions that could not reasonably have been identified before work began.

    Examples may include:

    • Damaged or deteriorated wiring

    • Improperly installed existing electrical systems

    • Unpermitted previous work

    • Inadequate grounding or bonding

    • Overloaded circuits

    • Defective panels or electrical equipment

    • Inadequate electrical capacity

    • Concealed junction boxes

    • Underground utilities

    • Structural obstructions

    • Hard rock, concrete, masonry, or other concealed obstacles

    • Water intrusion or previous property damage

    • Existing code violations

    • Hazardous materials

When these conditions affect the work, Bright Right may stop work, notify the Customer, and provide a Change Order or other written authorization for the additional work required.

    5. Existing Electrical Systems

Unless expressly included in the Scope of Work, Bright Right is not responsible for correcting defects or deficiencies in existing electrical systems unrelated to the contracted work.

Installation of new equipment assumes that the property's electrical system, service, grounding, polarity, capacity, and related infrastructure are adequate for the equipment being installed.

If existing conditions prevent safe or proper installation, additional repairs or upgrades may be required.

    6. Code Requirements and Inspections

Bright Right performs its work in accordance with applicable electrical requirements and the Scope of Work contained in the applicable agreement.

Opening or modifying an existing electrical system may reveal conditions that require additional corrections before an inspector or authority will approve the work.

Unless specifically included in the Scope of Work, the original contract price does not include bringing unrelated portions of the property or electrical system into current code compliance.

Any additional work required by an inspector, utility company, municipality, or other authority that is outside the original Scope of Work may require a Change Order.

    7. Permits

When the applicable agreement states that Bright Right will obtain required permits, Bright Right will obtain permits associated with the contracted Scope of Work.

Permit fees and responsibilities will be handled as specified in the applicable proposal or contract.

Additional requirements imposed by a permitting authority that are outside the original Scope of Work may result in additional charges.

    8. Utility Companies and Third Parties

Certain electrical projects require coordination with utility companies, inspectors, municipalities, equipment manufacturers, other contractors, or other third parties.

Bright Right cannot control their schedules, requirements, approvals, processing times, shutdowns, inspections, equipment availability, or other actions.

Accordingly, Bright Right is not responsible for project delays caused by third parties or circumstances outside Bright Right's reasonable control.

    9. Project Scheduling and Delays

Start dates and completion dates are subject to the applicable written agreement.

Bright Right will make reasonable efforts to perform work according to the anticipated schedule but may experience delays caused by circumstances including:

    • Permit or inspection delays

    • Utility company scheduling

    • Material or equipment availability

    • Manufacturer delays

    • Weather

    • Customer-requested changes

    • Change Orders

    • Unforeseen site conditions

    • Other contractors

    • Inability to access the property

    • Customer payment delays

    • Governmental requirements

    • Events outside Bright Right's reasonable control

Reasonable delays caused by these circumstances will extend the anticipated project schedule as necessary.

    10. Customer Responsibilities

The Customer is responsible for providing Bright Right with reasonable and safe access to the property and work areas during scheduled work.

    The Customer is responsible for:

    • Providing accurate information concerning the property and existing systems

    • Providing access to electrical panels and work areas

    • Removing or protecting valuable and fragile personal property

    • Securing pets

    • Providing necessary property access

    • Making required selections and approvals in a timely manner

    • Making payments when due

    • Identifying known underground utilities, private lines, or other concealed conditions when applicable

The Customer should remove or protect furniture, electronics, artwork, vehicles, landscaping items, and other property located near the work area.

    11. Access to Walls, Ceilings and Finished Surfaces

Electrical installation and repair sometimes require access through drywall, plaster, ceilings, siding, flooring, concrete, landscaping, cabinetry, or other finished surfaces.

Unless specifically included in the Scope of Work, Bright Right's electrical work does not include restoration of paint, drywall texture, flooring, tile, cabinetry, landscaping, decorative finishes, or similar surfaces affected by reasonably necessary access to perform the electrical work.

Bright Right will use reasonable care when accessing finished areas.

    12. Customer-Supplied Equipment and Materials

When Bright Right agrees to install fixtures, equipment, devices, or materials supplied by the Customer, Bright Right is responsible for its installation workmanship but does not provide a warranty covering the Customer-supplied product itself.

Additional labor required because Customer-supplied equipment is defective, incomplete, incompatible, incorrectly specified, damaged, or missing required components may result in additional charges.

Manufacturer warranty claims for Customer-supplied products are generally the Customer's responsibility unless Bright Right agrees otherwise in writing.

    13. Materials and Equipment

Unless a particular manufacturer, model, grade, or specification is identified in the Scope of Work, Bright Right may use commercially appropriate materials suitable for the installation.

Product availability may change. When specified equipment becomes unavailable, Bright Right may propose a reasonably comparable substitute, subject to any approvals required under the applicable agreement.

    14. Hazardous Materials

Bright Right does not perform asbestos, lead, mold, PCB, or hazardous-material remediation unless expressly agreed to and legally authorized.

If suspected hazardous materials are discovered, Bright Right may immediately stop affected work until the condition has been evaluated and, where necessary, remediated by a properly qualified professional.

Any resulting delay may extend the project schedule.

    15. Payment

Payment terms are specified in the applicable proposal, invoice, service agreement, or contract.

Unless otherwise stated in writing, payment for completed services is due upon completion.

Bright Right reserves the right, subject to applicable law, to suspend additional work when payments are past due.

Past-due balances may be subject to interest, collection expenses, attorneys' fees, and other charges where authorized by the applicable agreement and permitted by law.

    16. California Home Improvement Projects

Residential home improvement projects are subject to applicable California contractor laws and regulations.

For covered home improvement contracts, down payments generally may not exceed $1,000 or 10% of the contract price, whichever is less, except where otherwise permitted by California law.

Progress payments will be structured in accordance with applicable California requirements and the Customer's written contract.

Project-specific payment terms contained in the signed contract control.

    17. Right to Stop Work

Bright Right may suspend work when reasonably necessary because of:

    • Failure to make payments when due

    • Unsafe working conditions

    • Hazardous materials

    • Lack of property access

    • Customer interference with the work

    • Required approvals that have not been obtained

    • Discovery of conditions requiring additional authorization

    • Circumstances making continued work unsafe or unlawful

Work may resume after the condition causing the suspension has been resolved.

    18. Cleanup

Bright Right will remove debris and surplus materials generated by its work and leave the immediate work area in a reasonably neat, broom-clean condition.

Unless expressly included in the Scope of Work, construction cleaning, professional cleaning, landscaping restoration, painting, drywall finishing, or similar restoration services are not included.

    19. Work Performed by Others

Bright Right is not responsible for workmanship, defects, delays, damages, modifications, or failures caused by other contractors, property owners, tenants, utility providers, manufacturers, or other third parties.

Work performed by another person after Bright Right completes its work may affect applicable workmanship warranties if that work modifies, damages, or interferes with Bright Right's installation.

    20. Workmanship and 100% Satisfaction Guarantee

Bright Right is committed to quality workmanship and exceptional customer service.

If, within thirty (30) days following substantial completion, the Customer believes work performed by Bright Right does not conform to the agreed Scope of Work or was not completed in a professional and workmanlike manner, the Customer should notify Bright Right in writing.

Bright Right must be provided a reasonable opportunity to inspect the reported condition and, when Bright Right determines that a covered workmanship deficiency exists, correct the deficiency at no additional cost.

The Satisfaction Guarantee applies to workmanship and services performed by Bright Right. It does not cover conditions outside Bright Right's control, including:

    • Pre-existing conditions or defects

    • Structural deficiencies

    • Deteriorated building components

    • Manufacturer or product defects

    • Customer-supplied products

    • Normal wear and tear

    • Misuse, abuse, or neglect

    • Power surges or utility conditions

    • Damage caused by others

    • Modifications performed by others

    • Acts of God or casualty events

    • Changes to the property following installation

The Customer must provide Bright Right a reasonable opportunity to inspect and correct an alleged workmanship deficiency.

    21. Manufacturer Warranties

Products and equipment may be covered by separate warranties provided by their respective manufacturers.

Manufacturer warranties are independent from Bright Right's workmanship obligations and are subject to the manufacturer's own terms, limitations, exclusions, registration requirements, and claims procedures.

    22. Limitation of Liability

To the extent permitted by applicable law and the Customer's written agreement, Bright Right is not responsible for indirect or consequential losses resulting from circumstances outside Bright Right's reasonable control, pre-existing property conditions, product failures, utility failures, work performed by others, or conditions outside the agreed Scope of Work.

Any contractual limitation of liability contained in the Customer's signed agreement will control over this general website provision.

Nothing in these Terms is intended to waive or limit any right or remedy that cannot legally be waived or limited under California law.

    23. Insurance

Bright Right LLC maintains general liability insurance and maintains other insurance required by applicable law for its operations.

Customers should maintain appropriate property and casualty insurance for their property and belongings during construction and electrical work.

    24. Cancellation Rights

California law provides consumers with cancellation rights for certain home improvement, home solicitation, and service-and-repair transactions.

The specific cancellation notice and cancellation period applicable to a project will be provided in the Customer's contract when required by law.

Customers should review the Notice of Cancellation contained in their signed agreement for the cancellation deadline, instructions, and address for submitting a cancellation.

Nothing contained on this website is intended to reduce a Customer's statutory cancellation rights.

    25. Mechanics Liens

California law provides mechanics-lien rights to certain contractors, subcontractors, laborers, and material suppliers who provide labor or materials to improve real property and are not paid.

Homeowners may receive statutory notices explaining mechanics liens, preliminary notices, lien releases, and ways to protect themselves.

Any notices required for a particular project will be provided in accordance with applicable California law.

    26. Subcontractors

Bright Right may use properly licensed and qualified subcontractors to perform portions of a project when appropriate.

    27. Electronic Communications and Signatures

Where permitted by law, estimates, proposals, contracts, Change Orders, invoices, approvals, notices, and other project communications may be transmitted electronically.

Electronic signatures and electronic acceptance may be treated as binding to the extent permitted by applicable law.

    28. Governing Agreements

These website Terms & Conditions provide general information concerning Bright Right's service policies.

They do not replace the Customer's project-specific written agreement.

The applicable estimate, proposal, home improvement contract, service agreement, Change Orders, and other documents signed or accepted by the parties constitute the governing agreement for the project.

If there is a conflict between these website Terms & Conditions and a project-specific signed agreement, the signed agreement controls.

    29. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
